The Chapter 7 Bankruptcy Process

Unemployment, unexpected medical expenses, or divorce are common reasons people need relief from debt. Whatever the reason, bankruptcy may be the solution to provide a fresh financial start. In Pennsylvania individuals most often file for either a Chapter 7 or Chapter 13 bankruptcy.  (Chapter 11 dealing with corporations and Chapter 12 dealing with farmers also exist).

A Chapter 7 bankruptcy in general allows you to discharge all of your unsecured debt and in most cases allows you to keep everything that you own. In some cases, you will have to surrender a few things, but most of the time you do not have to do so.   Under a Chapter 7 your debts are discharged in as little as six months. Relief is immediate and you are on your way to a new beginning.

A Chapter 13 bankruptcy, also known as a wage earner plan, allows you to catch up on secured debts such as your house or car. This is the preferred plan for those who have fallen behind on payments for valuable assets and wish to remain in possession of their property. This type is also favorable to those who have a steady income that is too high to qualify for a Chapter 7 and desire to set up regular payments.
