How Important Are Documents to Your Case?
As it turns out, maintaining original documents can make or break your case. I recently had a case involving a business dispute between two parties. The other side had kept a copy of a portion of a contract, but not the entire document.
On the eve of the trial, we raised the issue of the failure to preserve the original contract with the Court. On the day of the trial – after we picked a jury – the Court dismissed the case and sent the jury home. My client left happy. The party who neglected to preserve the document? Not so much.
